TERMS OF SERVICE

These Terms of Service govern your use of naviradeck.com and any purchase made from Navira.

The website and online store are operated by Aura-X Marine SLU under the trading name Navira (“Navira”, “we”, “us” or “our”).

By accessing this website or placing an order, you agree to these Terms of Service. If you do not agree, you should not use the website or place an order.

1. ELIGIBILITY

By using this website or placing an order, you confirm that you are legally capable of entering into a binding contract.

If you purchase on behalf of a company or another person, you confirm that you have authority to act on their behalf.

2. PRODUCTS AND SERVICES

Navira supplies marine products, including natural teak Deck-Kits, synthetic Deck-Kits, cushions, prefabricated components and related accessories.

We make reasonable efforts to display product descriptions, materials, colours, dimensions, compatibility and images accurately. However:

• Colours and finishes may vary depending on the screen, lighting and natural material characteristics.
• Natural teak may show variations in colour, grain and appearance.
• Product images may include illustrative or generic representations.
• Minor variations resulting from manufacturing processes do not constitute a defect when they do not affect the product’s function, installation or agreed specifications.

The product description, selected options and confirmed order determine the product included in the purchase.

3. BOAT COMPATIBILITY

The customer is responsible for checking the boat manufacturer, model, production year, version, layout and selected product configuration before placing an order.

Boats of the same commercial model may have differences resulting from production changes, previous modifications, repairs, optional equipment or different layouts.

If there is any uncertainty, the customer must contact info@naviradeck.com before purchasing.

Navira may request photographs, measurements, hull identification details, templates or other information to verify compatibility. Any assistance provided by Navira is based on the information supplied by the customer and does not remove the customer’s responsibility to provide complete and accurate information.

4. MADE-TO-ORDER PRODUCTS

Deck-Kits, cushions and other products manufactured, cut or configured for a particular boat, model, layout, measurement or customer specification are made-to-order products.

Production may begin after:

• Payment has been received or confirmed.
• The required boat information has been provided.
• The selected model, version and configuration have been confirmed.
• Any drawings, dimensions, templates or specifications requested by Navira have been approved.

Once production has started, changes may not be possible. If a requested modification is technically possible, Navira may charge the customer for additional design, materials, manufacturing or delivery costs.

Made-to-order or clearly personalised products cannot be cancelled or returned because the customer changes their mind or provides incorrect boat information. This does not affect the customer’s rights when a product is defective, damaged, incorrectly manufactured or does not correspond to the confirmed order.

5. ORDERS

An order placed through the website constitutes an offer to purchase.

An automatic order confirmation acknowledges receipt of the order but does not necessarily mean that the order has been accepted.

Navira may reject or cancel an order before acceptance when:

• The product is unavailable.
• There is an evident pricing or product-information error.
• Payment cannot be authorised.
• Delivery cannot reasonably be completed.
• Required product or boat information is missing.
• Fraud, misuse or an unlawful transaction is reasonably suspected.

If Navira cancels an order after payment has been received, the amount paid will be refunded using the original payment method.

6. PRICES AND PAYMENT

Prices are displayed in the currency indicated on the website.

Applicable VAT or other taxes will be shown during checkout or on the corresponding commercial documentation, depending on the customer, destination and applicable tax rules.

The customer must provide accurate billing, delivery and payment information.

Payment is processed through the payment methods available at checkout. Navira does not directly store complete payment-card details.

Navira may correct an evident pricing error before accepting an order. If an order has been placed at an incorrect price, the customer will be informed and may confirm the order at the correct price or receive a full refund.

7. INTERNATIONAL ORDERS, CUSTOMS AND IMPORT CHARGES

For deliveries outside the European Union, the customer may be responsible for import duties, customs charges, local taxes, brokerage fees and other destination-country costs unless expressly stated otherwise during checkout or in the order confirmation.

These charges are not controlled by Navira and are not included in the product price or shipping charge unless expressly indicated.

The customer is responsible for providing any information required for customs clearance and for complying with with the import requirements of the destination country.

Delays caused by customs procedures or missing customer documentation are outside Navira’s direct control.

8. SHIPPING AND DELIVERY

Estimated manufacturing and delivery times are indicative unless Navira expressly confirms a binding delivery date in writing.

Manufacturing times begin once payment and all information required to produce the order have been received and confirmed.

Delivery may be affected by material availability, production requirements, carrier operations, customs procedures, weather or circumstances outside Navira’s reasonable control.

The customer must provide a complete and accurate delivery address and ensure that someone can receive the shipment when required.

If a delivery fails because the address or contact information provided by the customer is incorrect, or because the customer does not accept or collect the shipment, additional storage, return or redelivery costs may be charged to the customer.

Nothing in this section limits the mandatory delivery rights granted to consumers by applicable law.

9. INSPECTION ON DELIVERY

The customer should inspect the shipment and packaging upon delivery.

Any visible transport damage should be recorded with the carrier whenever possible. The customer should retain the packaging and contact Navira as soon as reasonably possible at info@naviradeck.com, providing:

• The order number.
• A description of the problem.
• Clear photographs of the product.
• Photographs of the internal and external packaging.
• Photographs of the shipping label where relevant.

Failure to notify immediately does not remove any mandatory consumer rights, but early notification helps Navira investigate the claim and arrange an appropriate solution.

10. INSTALLATION AND USE

Products must be inspected and dry-fitted before cutting, bonding, sealing or permanently installing them.

The customer must follow the installation instructions and use suitable adhesives, sealants, tools and preparation methods.

Installation should be carried out by a competent person with appropriate marine-installation experience where the work requires technical knowledge.

The customer must not permanently install a product that is visibly damaged, incorrect or incompatible without first contacting Navira.

Navira is not responsible for damage caused by:

• Incorrect installation or surface preparation.
• Unsuitable adhesives, sealants, tools or chemicals.
• Failure to follow installation or maintenance instructions.
• Alteration, cutting or modification not approved by Navira.
• Incorrect measurements or boat information supplied by the customer.
• Normal wear, weathering or changes inherent to natural materials.
• Misuse, impact, neglect or inadequate maintenance.

This section does not exclude liability for a defect that existed when the product was delivered or any right that cannot legally be excluded.

11. RETURNS AND REFUNDS

Returns, withdrawals, exchanges and refunds are governed by Navira’s Return and Refund Policy, available on the website.

Standard, non-personalised products may be eligible for withdrawal within 14 calendar days after receipt, subject to the conditions stated in that Policy.

The right of withdrawal does not apply to products manufactured according to the customer’s specifications or clearly personalised, including Deck-Kits, cushions and products manufactured, cut or configured for a specific boat, model, measurement or selected configuration.

This exception does not affect the customer’s rights regarding defective, damaged or incorrect products.

12. LEGAL GUARANTEE AND DEFECTIVE PRODUCTS

Products supplied to consumers are covered by the mandatory legal conformity rights established by applicable consumer law.

If a product is defective, incorrectly manufactured or does not correspond to the confirmed order, the customer should contact info@naviradeck.com with the order details and supporting photographs.

Depending on the circumstances and applicable law, the appropriate remedy may include repair, replacement, price reduction or refund.

Any commercial warranty offered for a particular product will be additional to, and will not replace or reduce, mandatory consumer rights.

13. WEBSITE USE

The customer must not use this website:

• For unlawful or fraudulent purposes.
• To transmit malicious code, viruses or harmful content.
• To interfere with the website’s security or operation.
• To obtain unauthorised access to systems or customer information.
• To copy, scrape or commercially exploit website content without authorisation.
• To provide false, misleading or fraudulent information.
• To infringe intellectual-property, privacy or other legal rights.

Navira may restrict access or cancel an order when misuse, fraud or unlawful activity is reasonably suspected.

14. INTELLECTUAL PROPERTY

All website content, including the Navira name, logos, text, photographs, product images, drawings, designs, graphics, software and layout, is owned by or licensed to Aura-X Marine SLU and is protected by applicable intellectual-property law.

No content may be copied, reproduced, distributed, modified, published or used commercially without prior written permission.

Purchasing a product does not transfer intellectual-property rights in its design, technical drawings, manufacturing files or production methods.

15. THIRD-PARTY SERVICES AND LINKS

The website may use or link to services operated by third parties, including Shopify, payment providers, carriers and other service providers.

Those services may be governed by their own terms and privacy policies.

Navira is not responsible for the content, availability or independent practices of third-party websites. This does not affect Navira’s responsibility for service providers used to perform its obligations to customers where applicable law provides otherwise.

16. PRIVACY AND COOKIES

Personal data is processed in accordance with Navira’s Privacy Policy and applicable data-protection law.

The website uses cookies and similar technologies. Essential cookies may be used when necessary for the website, cart and checkout to operate. Non-essential cookies will only be activated with consent where legally required.

17. LIABILITY

Navira is responsible for losses that are a foreseeable consequence of a breach of these Terms or applicable law.

To the extent permitted by law, Navira is not responsible for indirect business losses, loss of profit, loss of revenue or loss of opportunity arising from a consumer purchase.

Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, defective products or mandatory consumer rights.

Customers purchasing products for business or professional purposes may be subject to different mandatory legal protections from those applicable to consumers.

18. FORCE MAJEURE

Navira will not be liable for a delay or failure caused by circumstances beyond its reasonable control, including natural disasters, fire, flooding, war, civil disturbance, strikes, transport disruption, customs delays, epidemics, government action, energy failures, cyber incidents or supply-chain interruption.

Navira will take reasonable measures to reduce the impact and resume performance. If performance becomes impossible or is delayed substantially, the customer will be informed and will retain any mandatory rights available under applicable law.

19. CHANGES TO THESE TERMS

Navira may update these Terms to reflect legal, commercial, operational or technological changes.

The Terms applicable to an order are those accepted when the order is placed. Later changes will not retrospectively alter an existing order unless required by law or expressly agreed with the customer.

The latest version will be published on this page with its revision date.

20. SEVERABILITY

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

Any invalid provision will be interpreted or replaced, where legally possible, in a manner that most closely reflects its original lawful purpose.

21. GOVERNING LAW AND DISPUTES

These Terms and purchases made from Navira are governed by Spanish law.

If the customer is a consumer resident in another country, this choice of law does not remove any mandatory consumer protection granted by the law of their country of residence.

The parties will attempt to resolve any dispute directly and in good faith.

For consumers, jurisdiction will be determined by the mandatory rules applicable to consumer contracts. Nothing in these Terms requires a consumer to bring proceedings exclusively before courts other than those available under applicable law.

For transactions between businesses, and where legally permitted, the parties submit to the competent courts corresponding to the registered office of Aura-X Marine SLU.
